OFFICIAL CC -Game-On Mario Kart Player Handbook

Eligibility

1. To be eligible to compete in the CC Game-On Mario Kart Time Trials tournament players must pay a $5-10 entree fee per attempt. (See CC Game-On Rulebook for price breakdown) Players that are underage MUST consult with a parent or guardian to compete in the tournament. (See section 15 for Refund Policy)

Equipment

2. All equipment necessary to compete in the Time Trials tournament will be provided by CC Game-On. This includes but is not limited to Nintendo Switches, Joycons, Mario Kart, Monitors, etc. (See CC Game-On Rulebook for more information on Equipment Provided)

Tournament Rules and Conduct

3. By participating in the Tournament, you agree to comply with all Tournament rules and regulations, including but not limited to the game-specific rules, format, player handbook and schedule. You also agree to conduct yourself in a sportsmanlike manner and to refrain from any behavior that may be deemed inappropriate, disruptive, or offensive by CC Game-On, including but not limited to cheating, harassment, discrimination, or violence. CC Game-On reserves the right to disqualify you from the Tournament or take other disciplinary action if you violate any of these rules or engage in any prohibited behavior.

Waiver and Release

4. By participating in the CC -Game-On Tournament, you acknowledge and assume all risks associated with gaming competition. This includes but is not limited to physical, mental and emotional harm, as well as loss or damage to property. You waive any and all claims against CC Game-On, its staff, affiliates and vendors for any injury, loss, or damage that may arise from your participation in the tournament. You also agree to release CC Game-On from any liability for any such injury, loss or damage, whether or not caused by negligence or misconduct of CC Game-On or any other party.

Intellectual Property

5. You acknowledge and agree that CC Game-On owns all intellectual property rights in the tournament, including but not limited to the tournament name, logo, etc. You may not use or reproduce any such intellectual property without the express written permission of CC Game-On.

Privacy

6. CC Game On collects personal information from participants in order to administer the tournament and comply with legal requirements. By participating in the tournament, you consent to CC Game-On’s collection, use and disclosure of your personal information for these purposes. CC Game-On will NOT share your personal information with any third party without your consent, except as required by law or as necessary to administer the CC Game-On tournament.

Disclaimer of Warranties

7. CC Game-On makes no warranties or representations of any kind, whether express or implied, regarding the tournament including but not limited to the quality, accuracy, reliability, completeness, or suitability of any information, products, services, or materials provided in connection with the tournament. CC Game-On expressly disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement

Limitation of Liability

8. CC Game-On shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of or in connection with the tournament. This includes but is not limited to losses or damages of any kind. This limitation of liability applies regardless of the form of action, whether in contract, tort, negligence or otherwise, and even if CC Game-On has been advised of the possibility of such damages.

Indemnification

9. You agree to indemnify, defend, and hold harmless CC Game-On, its employees, affiliates, and vendors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your participation in the tournament or your breach of this agreement.

Modification and Termination

10. CC Game-On reserves the right to modify , suspend, or even terminate the tournament or this agreement at any time and for any reason, with or without notice to participants. CC Game-On shall not be liable to participants or any third party for any such modification, suspension, or termination.

Governing Law and Dispute Resolution

11. This agreement shall be governed by and constructed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of the conflicts of law. Any dispute arising out of or in connection with this agreement or the tournament shall be resolved through arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Camp Hill, Pennsylvania, and the award rendered by the arbitrator shall be final and binding on all parties.

Entire Agreement

12. This agreement constitutes the entire agreement between you and CC Game-On regarding your participation in the tournament, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and CC Game-On.

Severability

13. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Disqualification

14. If any of the rules or regulations are broken then you will be disqualified from the tournament, no exceptions. If players are not in their seats and prepared for their match in time stated by staff after the match is scheduled to begin then you will also be disqualified.

Refund Policy

15. CC Game-On is not able to do refunds in the event the player requests one. This ensures that registration for the event and day of schedule is smooth for staff, participants and overall event day.
